- According to experts, such actions not only erode the credibility of the Judiciary but also contravene constitutional morality by violating Article 50 of the Constitution.
- Article 50 mandates that the State must take measures to ensure the separation of the judiciary from the executive in public services.
- Moreover, there is a potential for post-retirement positions to impact decisions made prior to retirement.
- In this context, the Constitution does not address the post-retirement rehabilitation of judges by the executive.
- Nevertheless, in 1997, the Supreme Court adopted the “Restatement of Values of Judicial Life,” which includes principles such as avoiding any actions that diminish the judiciary’s credibility.
- Additionally, the 14th Law Commission Report (1958) proposed that judges should be prohibited from taking up employment with the Union or the state as a post-retirement position.

Supreme Court (SC) Approves Rajasthan Government’s Two-Child Rule
- The court affirmed the constitutionality of Rule 24(4) within the Rajasthan Police Subordinate Service Rules, 1989, considering it not against the constitution and non-discriminatory.
- This rule sets a maximum limit of two children for candidates.
- A comparable provision was also endorsed by the Supreme Court in the 2003 case of Javed vs. State of Haryana,
- Initially the two children rule was introduced as an eligibility criterion for participating in panchayat elections.
