Summary of Today’s News

HC says Uttar Pradesh Madrasa Education Act ‘unconstitutional’

• Allahabad High Court on Friday said the Act violates principles of secularism and declared the Madarasa Education Act as unconstitutional.
• The court said that the State has no power to create a board for religious education or to establish a board for school education only for a particular religion and philosophy associated with it.
• The Madarsa Act violated the principle of secularism and Articles 14, 15 and 21-A of the Constitution — said it was the duty of the State to provide education, which is secular in nature, more particularly for minors, i.e., children up to the age of 18.
• The Constitution of India Says that it is the duty of the state to provide education which is secular in nature.
• Providing different religious education to different religious communities is the violation of basic structure of the constitution and such education or action is highly divisive of the society on religious lines.
• The state cannot hide itself behind the excuse that it is providing traditional education on nominal fee.
• The Supreme Court has emphasized in many cases to provide modern education which lead a bright future of children to take country forward.
• It does not prescribe, by any stretch of imagination, limited education with emphasis only upon a particular religion.
• The court directed the government to take steps forthwith for accommodating these students in regular schools recognised under the Primary Education Board and schools recognised under the High School and Intermediate Education Board of Uttar Pradesh.

Can Arvind Kejriwal continue to be CM while in custody?

• According to earlier judgments of the Supreme Court and High Courts the constitutional morality, good governance, and constitutional trust are the basic norms for holding a public office.
• The government has to rise above narrow private interests or parochial political outlook and aim at doing well for the larger public interest.
• The third was constitutional trust, that is, to uphold the high degree of morality attached to a public office.
• Practical problems- For one, a “Minister sitting in prison cannot ask the Secretary of the State to get the files concerning any of the departments without breaching the oath of office”, it was pointed out.
• On the other hand, should a person be paid salary from the State exchequer while occupying a public office without performing any duty attached to the office he held.
• So he is not completely suffering a disqualification.
• But we can expect that persons in power must have high standards of moral conduct. “Political compulsion cannot outweigh the public morality, requirements of good/clean governance and constitutional morality.
